Official Rules

ELIGIBILITY: Taste of Muskegon Restaurant Bingo Sweepstakes (“Sweepstakes”) is open to legal residents of the 50 United States and the District of Columbia (excluding Florida and New York). Subject to all applicable federal, state and local laws and regulations.

HOW TO ENTER: To enter, download a Sweepstakes Bingo Card (the “Card”) from www.TasteofMuskegon.com (the “Website”) during the Sweepstakes Entry Period (as defined below), fulfill the purchase requirements described in these Official Rules, and submit a completed Card to Sponsor for entry into the Prize Drawing (as defined below). Once a participant checks-in via QR code for each of five (5) participating locations (the “Locations”)-one from each category, which Locations are printed on participant’s Card, the Card will be deemed “complete” for purposes of this Sweepstakes and participant can submit the Card to Sponsor for entry into the Prize Drawing. A completed Card must be submitted via www.TasteofMuskegon.com by Noon ET before January 29, 2022 to be eligible for the Prize Drawing. Participants will receive one (1) extra entry into the Prize Drawing for each additional five (5) Locations referenced on the Card where such participant makes a Qualifying QR code check in during the Sweepstakes Period. 

Alternatively, to receive a free entry into the Prize Drawing without completing a Card or making any Qualifying Purchases, print your first and last name, mailing address, and email address, on a 3x5 piece of paper and mail, in an envelope with proper postage affixed, to: “Taste of Muskegon Bingo Sweepstakes, Free Sweepstakes Entry Request, c/o Taste of Muskegon – 933 Terrace St, Muskegon, MI 49440.” Free code requests must be received by January 29, 2022. Limit one (1) free entry per address, per mailing envelope, per day.

All entries must be received between January 3-29, 2022, 12:PM ET (“Sweepstakes Entry Period”). Entries delayed or received after the expiration of the Sweepstakes Entry Period will not be accepted and will be destroyed. Limit one (1) entry per person and/or per email address during the Sweepstakes Entry Period. All entries will be deemed made by the authorized account holder of the email address submitted at time of entry. The “authorized account holder” is the natural person assigned an e-mail address by an internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. A selected participant may be required to provide Sponsor with proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. Sponsor is not responsible for lost, late, damaged, incomplete, illegible or misdirected entries. Entries become the property of Sponsor and will not be returned. Sponsor will not verify receipt of entries.

PRIZES: Each prize consists of restaurant gift card or culinary prize package. Prizes are non-transferable.

ODDS: Odds of winning a Prize depend on the total number of eligible entries received during the Sweepstakes Entry Period.

WINNER SELECTION/NOTIFICATION: Prize winners will be selected in a random drawing (“Prize Drawing”) from among all eligible entries received by Sponsor on or about February 11, 2022 conducted by Sponsor or its authorized designee. All eligible entries received during the Sweepstakes Entry Period will be entered into the Drawing. Prize winners will be notified within five (5) days after the Drawing by e-mail. Potential winners will be required to sign and return an Affidavit of Eligibility & Liability and a Publicity Release (“Affidavit and Release”) (except where prohibited by law) within ten (10) days of date provided in the applicable notification or he/she will be disqualified. If a potential winner cannot be contacted within seven (7) days of the first attempt to contact him/her, or if he/she fails to return the signed Affidavit and Release within seven (7) days, or if the potential winner is deemed ineligible for any other reason in Sponsor’s sole discretion, the potential winner will be disqualified (except where prohibited by law) and an alternate winner will be selected in his/her place by random drawing amongst all remaining eligible Sweepstakes entries received. Winning a Prize is contingent upon fulfilling all requirements set forth herein and all Prizes will be awarded within thirty (30) days after Sponsor’s verification of the selected winner’s eligibility in accordance with these Official Rules. No substitution of any Prize permitted. Sponsor may substitute any Prize or any portion thereof for one of equal or greater value due to unavailability. All federal, state and local taxes, including but not limited to income and sales taxes, are the sole responsibility of winner. Winners will receive an IRS Form 1099 reflecting the actual final retail value of his/her Prize. Acceptance of a Prize constitutes permission (except where prohibited by law) to use winner’s name, prize won, voice, hometown and likeness for purposes of advertising, trade promotion, online posting and publicity without additional compensation.

GENERAL: Participation and entry in the Sweepstakes constitutes participants full and unconditional agreement to and acceptance of these Official Rules, including, without limitation, participant’s consent to receive email messages from Sponsor. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair practices (including the use of automated entry programs), may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. By entering and participating in the Sweepstakes, participants release the Sweepstakes Entities from all liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of in connection with the Sweepstakes or with the acceptance, possession or use of any Prizes, including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, and you agree that the Sweepstakes Entities have not made, and are in no matter responsible for, any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the Sweepstakes and/or any Prize or the use thereof. Without limiting the generality of the foregoing release, the Sweepstakes Entities are not responsible and will not be liable for (a) any incomplete, incorrect or inaccurate information, whether caused by participants or by any of the equipment or programming associated with or utilized in the Sweepstakes, or by any technical or human error which may occur in the processing of entries in the Sweepstakes; (b) any error, omission, interruption, deletion, defect, or delay in operation or transmission, communications line failure, traffic congestion on the internet or the Website, or the failure of any email or mail to be received by or from Sponsor for any reason; (c) theft, destruction or unauthorized access to, or alteration of entries or the Website; (d) any problems with or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software or failure of e-mail on account of technical problems; or (e) any injury or damage to participant's or to any other person's computer hardware and/or software related to or resulting from participating in the Sweepstakes. Notwithstanding the foregoing, in the event that preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, Sweepstakes participant agrees that, by entering the sweepstakes, any and all disputes, claims and causes of action arising out of in connection with the Sweepstakes or Prizes awarded, shall be resolved individually without resort to any form of class action; any claims judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes but in no event attorney’s fees and under no circumstances will any participant be permitted to obtain any award for and participant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out of pocket expenses. Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Georgia without giving effect to any choice of law or conflict of law rules (whether of the State of Georgia or any other jurisdiction). Sponsor reserves the right to terminate, cancel, suspend and/or modify the Sweepstakes without liability and without prior notice if any factor interferes with its operation as contemplated by these Official Rules, including but not limited to any fraud, virus or other technical problem which corrupts the administration, security, or proper play of the Sweepstakes. In the event that this Sweepstakes is challenged by any legal or regulatory authority (including but not limited to any federal or state governmental authority), Sponsor reserves the right to discontinue or modify the Sweepstakes, as applicable, or to disqualify any participants residing in any affected geographic areas, as applicable. In such event, Sponsor shall have no liability to any participants who are disqualified due to such an action. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Should any provision of these Official Rules be deemed unenforceable or invalid, the other provisions of these Official Rules shall remain in full force and effect.
